The mother of missing activist Jonas Burgos on Thursday asked the Supreme Court to overturn a Court of Appeals (CA) decision on his son’s case.
Edita Burgos filed a petition for review before the high court following the CA’s decision to junk the habeas corpus petition her family filed last year.
Last week the appellate court, in dismissing the petition for habeas corpus, said the Burgos family failed to prove that the military was behind the disappearance of the activist.
The CA also dismissed the family’s petition for contempt while the petition for writ of amparo was "partly granted."
The appellate court, however, clarified that its decision did not mean that Burgos is not in the hands of the military.
The CA directed the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) to continue its investigation since the direct link involving the Philippine Army in the disappearance is still unclear.
The CA also ordered both the military and police to submit its compliance report to the court 10 days after completing its investigation.
Earlier, Edita said she "extremely disappointed" over the CA decision.
"I am extremely disappointed. I do not know how to react because I was praying that I would be able to find my son after the decision is released, after the resolution has been given to us. But it looks like it will take a longer time for me to find my son," she said.
Burgos, son of the late press freedom fighter Joe Burgos was abducted on April 28, 2007 inside a mall in Quezon City. His family has linked the military to his disappearance but it repeatedly denied the allegation. With a report from Marieton Pacheco, ABS-CBN News
